The Competition Authority has decided to close the investigation of Jotun A/S regarding a possible violation of the Competition Act’s prohibition of abuse of a dominant position.
– The decision is based on an overall assessment of the case, says Director Magnus Gabrielsen.
At the same time he underlines that dominant undertakings have a special responsibility to make sure that its conduct does not impair competition.
– The Competition Authority’s preliminary assessment is that Jotun is a dominant undertaking in the market for sale of decorative paints in Norway, says Gabrielsen.
Decorative paints includes painting for exterior and interior use.
Considerable amount of investigation material
The Competition Authority completed a dawn raid at the premises of Jotun in Sandefjord in February 2014, and has since then investigated the case.
– We have reviewed a considerable amount of material that was secured as evidence during the dawn raid. In addition, the Competition Authority has completed several interviews and collected information from customers and competitors. The investigation has been time-consuming, but it has been necessary to secure a proper examination of the case, says Gabrielsen.
